PART 1: GUEST PARTICIPATION LIABILITY RELEASE & WAIVER
This document affects your legal rights. Please read carefully before signing.
This Guest Participation Liability Release Form (the “Release”) is an integral part of the Terms and Conditions of Pedal and Sea Adventures Inc. (operating as Pedal & Sea Adventures, hereinafter collectively referred to as the “Company”). Execution of this Release is a strict mandatory prerequisite for participation in any Company tour or activity.
1. Assumption of Inherent Risks
I hereby acknowledge and agree that the activities I am voluntarily choosing to participate in—including, but not limited to, cycling, hiking, yoga, pickleball, water-based activities, and vehicle transportation—inherently involve significant risks, dangers, and hazards. These risks include, but are not limited to: physical exertion, forces of nature, accidents, illnesses, collisions with vehicles or pedestrians, equipment failure, and terrain hazards. Knowing my own physical fitness, health, and skill levels, I freely accept and fully assume all such risks, both known and unknown, and the danger of personal injury, death, property damage, or loss resulting therefrom.
2. Release of Liability and Indemnity
In consideration of being permitted to participate in the tour, I hereby agree to waive any and all claims that I have or may in the future have against the Company and its directors, officers, employees, guides, agents, and representatives (collectively, the “Releasees”). I hereby release, hold harmless, and indemnify the Releasees from any and all liability for any loss, damage, expense, injury, or death that I, or my next of kin, may suffer as a result of my participation in the tour due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care on the part of the Releasees.
3. Responsibility for Minors / Dependents
I acknowledge that I am fully responsible for the safety, actions, and risks of any minor or adult for whom I am legally responsible on this tour. I extend the terms of this Release to cover all such individuals identified under my booking.
4. Binding Effect
This Release shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns, and legal representatives in the event of my death or incapacity.
PART 2: GENERAL TERMS & CONDITIONS
1. Scope of Application
These Terms and Conditions govern all retail tour programs operated by the Company for the 2026–2027 seasons. Wholesale, Custom, and Private Tours are subject to distinct, tailored agreements; where provisions conflict, the specific Wholesale/Custom/Private contract shall take precedence.
2. Pricing, Bookings, and Currency
Currency Jurisdictions: All retail tour pricing is stated, invoiced, and processed in Canadian Dollars (CAD$) unless otherwise stated.
US Dollar Estimates: Any advertised United States Dollar (USD$) pricing is a calculated approximation only. Final charges are subject to the currency exchange and interchange rates determined solely by the guest’s credit card provider at the time of transaction.
Pricing Fluctuation: Official pricing is maintained on the Company website and is subject to change due to market conditions or severe currency fluctuations. Once a booking is locked and deposited, the rate remains fixed.
Occupancy Allocation: Retail prices are calculated per person based on “Double Occupancy” (two occupants sharing a single room).
3. Deposits and Final Payments
Standard Retail Tour Booking: Requires an initial deposit of $750 CAD$ per guest. Bookings must be finalized through Guest Services via the Corporate Office at 1-877-777-5699.
Discounted & Promotional Pricing: Requires an initial deposit of 50% of the total tour price. Promotional bookings can be executed online via discount codes or manually through the Corporate Office.
Final Payment Schedule:
Payment invitations are sent electronically and can be secured online or completed via phone. A booking is not deemed contractually validated until both the deposit and final payment funds are cleared and fully received by the Company.
4. Cancellation and Deferral Policy (Retail)
All guest-initiated cancellations must be submitted formally in writing via email to info@PedalandSeaAdventures.com. The official cancellation date is marked by the day the email is received. The Company will issue a formal verification reply within one (1) business day.
A. Cancellation Policy Timelines by Tour Type:
Croatia and Greece Bike and Boat Tours: To qualify for a refund or deferral, cancellations must be received 90 days prior to the tour’s start date. For cancellations received less than 90 days prior to the tour start date, Section 4C applies.
All Other Tours: To qualify for a refund or deferral, cancellations must be received 75 days prior to the tour’s start date. For cancellations received less than 75 days prior to the tour start date, Section 4C applies.
B. Eligible Refund & Deferral Options (Cancellations meeting the timelines in Section 4A):
The guest may choose one of the following two options:
Option 1 (Deferral): Defer 100% of monies paid to a future tour date. Only one (1) deferral is permitted per booking. Deferrals must be redeemed (tour booked and scheduled) no later than December 31 of the calendar year following the initial cancellation year, after which the funds expire and forfeit completely. There is no administrative fee for deferrals.
Option 2 (Refund): Receive a refund of all monies paid, minus a $375 CAD$ Administrative Fee per guest booking. Refunds will be returned via the original payment method, unless structural barriers (e.g., card expiration or account closure) require an alternative transaction layout.
C. Late Cancellations:
No refunds or deferrals will be issued for cancellations received less than 90 days for Croatia and Greece Bike and Boat Tours, or less than 75 days for all other tours. The guest remains contractually liable for the full financial value of the tour booking.
5. Single Supplements
The Company provides opportunities for solo travelers, allocating a baseline minimum of one (1) solo slot per itinerary. While the Company will attempt to match solo travelers to avoid extra costs, if a pairing is unavailable or a single room is explicitly requested, tour-specific Single Supplement fees will apply.
6. Company Alterations or Cancellations
The Company reserves the right to cancel or modify any itinerary, schedule, or asset pool at any time due to operational requirements or safety factors.
If the Company cancels a tour under standard conditions, all monies paid will be refunded within ten (10) business days.
Force Majeure: If a tour is canceled due to acts of God, pandemics, labor strikes, weather anomalies, or government declarations, the Company will make every reasonable effort to provide comparable alternative itineraries, but is not liable for structural travel defaults beyond its control.
7. Travel and Trip Insurance Disclaimer
The Company is legally restricted by provincial regulations from selling travel insurance policies directly. The purchase of comprehensive travel and trip cancellation insurance is strongly recommended. The Company is not financially liable for secondary non-refundable expenses, including advanced airline bookings.
8. Equipment and Asset Infrastructure
Bicycle Rentals: Bicycles are verified for safety and operational condition. The Company reserves the right to substitute models due to supply line limitations. Substitutions will be adjusted to the lower financial rate.
Personal Property: Guests may bring their own equipment (bicycles, pickleball gear, yoga mats). The Company is not liable for the theft, loss, damage, or destruction of personal items brought on tour.
Support Fleet: Support vans and trailers are systematically maintained to Federal and Provincial standards. Self-guided tours explicitly exclude field support assets except for preset luggage transfers and logistics outlined in individual itineraries.
9. Safety Protocols and Field Governance
Helmet Mandate: All cycling guests must wear an approved, properly fastened helmet at all times while on a bicycle. Failure to adhere to safety policies will result in immediate removal from the tour without compensation.
Guide Authority: Company guides possess complete operational authority over safety decisions. Guides reserve the unilateral right to evaluate a guest’s physical capacity or behavior and may require a guest to step down from an activity or exit the tour completely at their own expense if safety thresholds are breached.
10. Medical Emergencies and Costs
In the event of a medical emergency, Company guides will attempt to render immediate first aid or coordinate public emergency responses. The Company does not assume liability for the administration, quality, or choices of local emergency medical care providers. All financial costs incurred for emergency services, evacuations, or medical transports are the sole responsibility of the guest. The guest explicitly authorizes the Company to pay for emergency infrastructure on their behalf if required, and subsequently invoice the guest or charge the credit card on file.
11. Luggage Allocation Limits
Land-Based Van Tours: Constrained by vehicle and trailer dimensions, guests are requested to limit their luggage to a maximum of two (2) pieces of airline carry-on sized luggage (21 inches or smaller) per person. Any guests requiring additional or larger sized luggage must contact the Head Office prior to arrival.
Croatia and Greece Bike and Boat Tours: Cabin sizes allow for larger and additional luggage if required.
12. Media Release Rights
The Company reserves the right to publish, duplicate, or distribute any photographic or digital media images captured during the tour or shared voluntarily by guests. This media may be leveraged across promotional channels, prints, and digital marketing materials without compensation or secondary royalties.
13. Financial Liability Cap
In the event that the Company is deemed liable for a breach of contract, negligence, or operational failure, the total aggregate financial liability of the Company to any individual guest is capped at the maximum financial value amount paid by that specific guest to the Company for the tour in question.
14. Jurisdiction
These Terms & Conditions and any accompanying waivers shall be governed by, interpreted, and enforced in accordance with the laws of the Province of Nova Scotia, Canada.
